Do not use this Web Site and/or the related services if You do not accept these Terms and Conditions of Use (“Terms and Conditions”). By using this Web Site, you are indicating your acceptance of these Terms and Conditions and agree to be bound by them. Blastapplications may revise these Terms and Conditions at any time by updating this posting without further notice to you. By using the Web Site, you agree to and acknowledge these Terms and Conditions and further agree to remain in compliance with these Terms and Conditions.  Should you breach these Terms and Conditions, blastapplications reserves the right to restrict or limit your access (and your IP address) to the Web Site.  The terms "You" and “Your” refer to all individuals and/or entities accessing this web site for any reason, whether or not you are a patient of the Company.

Use of the Web Site.

Blastapplications will investigate occurrences which may involve such violations and may cooperate with law enforcement authorities in prosecuting any such violations. Violations of system or network security may result in civil or criminal liability.

Prohibited Uses.

Blastapplications prohibits, and You agree not to use the Web Site to:

(a)           Delete or revise any material posted by any other user or entity.

(b)           Use any device, software or routine to interfere or attempt to interfere with the proper working of this Web Site.

(c)           Take any action which imposes an unreasonable or disproportionately large load on this Web Site’s infrastructure.

(d)           If you have a password allowing access to a non-public area of this Web Site, disclosing to or sharing your password with any third parties or using your password for any unauthorized purpose. You are responsible for all use of your registration, whether or not you authorize such use and You agree to immediately notify Blastapplications of any unauthorized use of Your registration or password.

In addition to the foregoing, Blastapplications prohibits You from:

(b)           Notwithstanding anything to the contrary contained herein, using or attempting to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search the Web Site other than the search engine and search agents available from the Web Site and other than generally available third party web browsers (e.g., Internet Explorer, Firefox, Safari);

(c)           Deciphering, decompiling, disassembling or reverse engineering any of the software comprising or in any way making up a part of the Web Site, including without limitation, the Company’s applications (each application is hereinafter referred to as an “App.”); or

(d)           Aggregating, copying or duplicating in any manner all or part of the Web Site Content or information available from the Web Site, without express written consent from Blastapplications.

Use of Material.

 Blastapplications authorizes You to view and download a single copy of the Material on the Website solely for your personal, noncommercial use.  In the event any material on the Website is not owned by the Company, such material has been specifically licensed for use by Blastapplications.  Any and all Material on the Website is property of Blastapplications (or specifically licensed to Blastapplications) and therefore not permitted to be copied, modified, amended or reproduced in any way without the prior, written consent of the Rights’ Holder(s).Blastapplications reserves the right to monitor analytics to determine abuses of these terms and conditions and to restrict access or take other legal action against abusers of this Policy.

 The contents of the Web Site, such as text, graphics, images, logos, button icons, software and other materials (collectively "Material") are property of Blastapplications or its content suppliers or clients and may be protected under both United States and foreign copyright, trademark and other laws. You are responsible for Your own communications and for the consequences of their posting. Blastapplications does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by users, nor does it endorse any opinions expressed by users. Blastapplications respects the intellectual property rights of others and request that the people who use the Web Site  do the same.  If you believe that your work has been reproduced and is accessible on the Web Site in a way that constitutes copyright infringement, you may notify us by providing our copyright agent with the following information in writing:

(a)           the electronic or physical signature of the owner of the copyright or the person authorized to act on the owner’s behalf;

Indemnity.

You agree to defend, indemnify, and hold harmless Blastapplications, its officers, directors, employees, representatives and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, resulting from your use of the Material or alleging Your breach of the terms of these Terms and Conditions.  Blastapplications will provide prompt notice to You of any such claim, suit, or proceeding and shall assist You, at your sole expense, in defending any such claim, suit or proceeding.

No WARRANTIES.BLASTAPPLICATIONS DOES NOT WARRANT THAT THE WEB SITE WILL OPERATE ERROR-FREE OR THAT THE WEB SITE AND ITS SERVER ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF THE WEB SITE OR THE MATERIAL RESULTS IN DAMAGE TO YOUR EQUIPMENT OR THE LOSS OR CORRUPTION OF DATA, BLASTAPPLICATIONS IS NOT RESPONSIBLE FOR SUCH DAMAGE OR FOR ANY ASSOCIATED COSTS.

BLASTAPPLICATIONS MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE MATERIAL, SERVICES, SOFTWARE, TEXT, GRAPHICS, AND LINKS.

Blastapplications Limitation on Liability.

Because Blastapplications is not involved in user-to-user dealings and does not control the behavior of participants on the Web Site and in the Blog, in the event that You have a dispute with one or more other users, You release Blastapplications (and our agents and employees) from claims, demands and damages (contractual, actual and consequential, direct and indirect, punitive) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Blastapplications is under no legal obligation to, and generally does not, control the information provided by other users which is made available through the Web Site. Other user’s information may, by its nature, be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. Limitation of Liability.

Blastapplications’s aggregate liability to You for all claims arising from the use of the Materials and the Web Site is limited to one hundred dollars ($100.00).

Termination.

If You breach any of these Terms and Conditions or if Blastapplications is unable to verify or authenticate any information you submit to the Web Site, Blastapplications may pursue all of its legal or equitable remedies including, but not limited to, deletion of Your postings from this Web Site and immediate termination of your registration, account or ability to access the Web Site and/or any other service provided to You by Blastapplications without further notice to you.

General.

Blastapplications makes no claims that the Materials may be lawfully viewed or downloaded outside of the United States. Access to the Materials may not be legal by certain persons or in certain countries. If you access the Web Site from outside of the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. These Terms and conditions are governed by the laws of the State of New York, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the courts having jurisdiction within the State of New York, County of New York. If any provision of these Terms and Conditions are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term.
